RIGHT OF WITHDRAWAL
A. Ready-to-Ship, Non-Personalized Goods
Consumers generally have a statutory right of withdrawal when purchasing non-personalized goods online.
Withdrawal Period
You have the right to withdraw from an eligible contract within 14 days without giving any reason.
For a normal purchase of goods, the withdrawal period begins when you or a third party designated by you, other than the carrier, receives the goods.
Exercising the Right of Withdrawal
To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement.
Please contact WePaintWatches:

You may use the following wording, although use of this wording is not mandatory:
I hereby withdraw from the contract concluded by me for the purchase of the following goods:
Product: ______________________
Ordered on: __________________
Received on: __________________
Name: ________________________
Address: ______________________
Date: _________________________
Consequences of Withdrawal
Where a valid statutory withdrawal is exercised, the applicable statutory rules regarding reimbursement and return of the goods apply.
The goods should be returned without unnecessary delay and handled with reasonable care.
Any reimbursement will be made using the same means of payment used for the original transaction unless otherwise expressly agreed.
B. Custom and Personalized Goods
The statutory right of withdrawal does not apply to goods that are not prefabricated and are manufactured according to the consumer's individual selection or specifications, or that are clearly tailored to the consumer's personal needs.
This applies in particular to:
-
custom hand-painted watches
-
individually commissioned hand-painted dials
-
products created according to a customer's personal reference materials
-
watches produced according to an individually approved design
Legal basis: Section 312g (2) No. 1 BGB.
Once such a personalized order has been concluded, there is therefore no statutory 14-day right of withdrawal merely because the customer changes their mind.
This exclusion does not affect statutory rights where the goods are defective or do not conform to the agreed specification.
C. Custom Painting or Work Performed on a Customer-Owned Watch
Where the contract concerns a service performed on a watch supplied by the customer, different statutory withdrawal rules may apply.
If the customer expressly requests that WePaintWatches begin performing the service before the expiry of the statutory withdrawal period, work may begin before the withdrawal period has expired.
For a paid service, the statutory right of withdrawal may expire once the service has been fully performed if, before performance begins, the customer:
-
expressly agrees that performance may begin before the end of the withdrawal period; and
-
confirms their understanding that the right of withdrawal will expire once the service has been fully performed.
These requirements follow Section 356 BGB.
Where legally required, WePaintWatches will obtain the customer's express consent before beginning such work.
